You did not have to ask this twice...Is war driving legal in Europe?
Anyway: I've been reading up on this subject for a Dutch webpage I wrote about wardriving. My opinion (and I haven't seen any contradicting opinion) is that locating the beacon signals of wireless networks falls under the provision for receiving broadcast signals set in the European treaty for human rights.
